Stuart Gaul | Owner, Lead Attorney

With nearly two decades as a practicing attorney, Stuart Gaul represents businesses and individuals, entrepreneurs, manufacturers, financial institutions, and nonprofits as both plaintiffs and defendants in contractual, corporate, real estate, and consumer disputes in federal and state courts, in arbitration, and before administrative panels.

 

Stuart serves as local counsel in matters before federal and state courts in Western Pennsylvania.

 

 

Prior to opening Gaul Legal, Stuart was a partner at Thorp Reed & Armstrong and served as judicial law clerk for the Honorable Sean J. McLaughlin in the U.S. District Court for the Western District of Pennsylvania.

Legal Wins

Just a few of Stuart’s legal successes include:

  • Helped entrepreneur to recover approximately $40 million in commissions wrongly withheld by multinational corporation and obtaining permanent injunction. Sensormatic Electronics Corp. v. First National Bank of Pa., 148 Fed. Appx.99 (3d Cir. 2005).
  • Represented management of closely held corporation in dispute with dissident shareholders, including trial in breach of contract action against shareholder corporation.
  • Represented construction company in bankruptcy court adversary proceeding involving fabrication of components for petrochemical plants in Indonesia, People's Republic of China. Case settled with opposing party walking away from $5.5 million claim.
  • Obtained summary judgment or voluntary dismissal of all claims against bank in class action alleging improper assessment of late charges on motor vehicle loans.
  • Obtained restoration of welfare benefits for retiree group under ERISA; Defeated motion for class certification in ERISA action arising from termination of retiree health benefit.
  • Obtained and preserved nonprofit's exemption from real property taxes, appearing in administrative proceedings, at trial and before appellate courts.
  • Obtained full deposit refund for homeowner from construction company that had not performed contracted home improvement work.
